TERMS & CONDITIONS

1. Artistic Discretion & Changes
Client is aware that the Photographer and a Film Maker is a “Documentary Wedding Photographer & Film Maker” and adheres to his own style. The final post production and editing styles, effects, and overall look of the images are left to the discretion of the Photographer. 
Client acknowledges that the Photographer is using his artistic discretion to shoot & process the pictures to best possible standard, the Film Maker create film as he sees fit and the designer designs the album keeping in mind the visual aesthetics and what looks best for the respective set of pictures. There cannot be any fundamental changes done in the pictures, wedding films we make and/ or the albums we design, except only adding or removing any (4-5 shots) can be done in the film, and only group photos will be rearranged, which also should be mutually decided.

2. Coverage
The Photographers/Cinematographers will be present on wedding/event days as per the time scheduled, and it is up to the Photographer/Film Maker when enough photo/film have been captured.
The client is responsible for having an authorized representative present during all shooting phases of the assignment. If no representative is present, the Photographer's interpretation shall be accepted.

3. Deliverable
As mentioned in the quotation.
The Photographer is not liable to deliver every image taken at the event. The determination of images delivered to the Client is left to the discretion of the Photographer. 
We do not use DVD anymore (as they are outdated for the high quality data size we work in). You have to provide a pen drive ( size depending on your data) or a Hard disk drive, in which we shall share the processed data with you.
The approximate duration of the Wedding film is mentioned in the quotation but the final duration of the film provided left to the discretion of the Film Maker since it is determined upon various factors like your events, the footage, what looks best to the editor and what gives the best idea of your entire events.
Being professional photographers, we handover only the final jpeg images- edited to best possible standards of your wedding events. No raw files will be given.
The Film Maker reserves the right to make any changes in the final film once they are delivered to the clients. Corrections or revision requested after two weeks will be chargeable.

4. Delivery Timelines
We try to share selected images ( Selection made by the photographer and the number of images selected left to the discretion of the Photographer ) in two weeks' time after the event. 
A minimum of 6 to 8 weeks will be required to deliver all your wedding pictures ( depending upon the wedding season ).
In case of cinematic video in first 3 months Full Length or Short Film & Next three months remaining video ( Full or short ). It is an intricate and time consuming process as we work on your pictures and films after we have shot them. This process can take longer than expected.

6. Permission to Coverage
It is the sole responsibility of the Client to secure permission of the church, synagogue, temples or other venue of the wedding/events for the Photographer/  Film Maker to shoot the ceremony/event.
The Client shall insure the placement of the bridal party, the officiant(s) and the altar decorations with respect to the suggestions & instructions by the Photographer & Film Maker so as to not obscure the view of the bride and groom.
The Photographer & the Film Maker will abide by the rules of the church/synagogue/temple in regards to camera placement during the ceremony. Many private venues/businesses are charging a photography/filming permit fee. The client is responsible for the payment of such fee. In the advent, the client fails or refuses to pay for any such permit fee despite having been informed by the Photographer/ Film Maker that such fee is required, client is responsible for any and all related costs or fines if applicable.

7. Lighting Conditions
The Photographer & the Film Maker makes no guarantee, either expressed or implied, in regard to the quality of the film, if the artificial lighting provided by the clients at the venue is unsuitable or too dark for photography or filming or if the available light is too harsh and not recommended for photography & filming.
It is strongly advised by the Photographer/ Film Maker to avoid any use of colored, LED, flashing, mono colored(red/green/blue/pink etc) mood lighting or any other form of colored or flickering lighting in the areas of coverage, sitting areas or performance areas for the events. Bright and even lighting should be provided in all ceremony and guest areas. Lighting in the event should be managed according to our requirement. This can be discussed before the event or the decor/lighting guys should be flexible on the day of the event. We do not give guarantee of the quality of images or video if artificial lighting given by client / venue/ decorators is unsuitable or too dark.

8. Payment Terms
An advance 50% of total photography & film charges
( 30% of the total photography charges, non-refundable, retainer fee ) is advised on commissioning the assignment. This payment guarantees the time set aside for the above mentioned wedding date and assures you that the event will be the top priority of the Photographer. The balance 50% of the total payment should be paid on the delivery of the soft copies of pictures.
In case of outstation/ destination Wedding, travelling and lodging expenses for the Team will be borne by the Client. It is the responsibility of the Client to ensure decent facilities for the team in such cases.
Receipt of travel tickets to be issued a week prior to the event date.
Any other item than mentioned in the final quotation would cost extra as per the requirement.
After booking confirmation, if you wish to change/alter your booked services only in a way i.e. your chosen event dates or location, we will do our utmost to accommodate these changes but it may not always be possible. Any requests for changes shall be in writing by the person who made the booking. All costs incurred due to the changes shall be borne by you.

5. Liability
The Photographer & the film maker is not responsible for compromised coverage due to causes beyond the control of the Photographer/ Film maker including but not limited to obtrusive guests, lateness of the client or guests, weather conditions, schedule complications, incorrect addresses provided to the Photographer/ Film maker, rendering of decorations, or restrictions of the locations, accident, loss of materials, acts of god, equipment or other failures.
The Photographer/ Film maker is not responsible for backgrounds or lighting conditions, interference from surrounding devices, unsuitable sounds and lights, access limitations which may negatively impact or restrict the photo/ film coverage. The Photographer is not held liable for missed coverage of any part of the event(s). The Photographer will not be held accountable for failure to deliver images of any individuals or any objects at the event(s).
This limitation on liability shall also apply in the event that digital data and related materials are damaged in storage or transport, lost through camera malfunction, lost in the mail, fire or otherwise lost or damaged without fault on the part of the Film Maker. Client understands the unpredictable and non-posed nature of photojournalism (assumption of risk) and waives any right to any civil action due to missed or lost film or digital data (including but not limited to unintentional infliction of emotional distress and negligence). In the event the Film Maker fails to deliver the film for any other reason, the Film Maker’s liability is limited solely to the return of payment received from the Client under this Agreement.

9. Copyrights of the work
We hold the complete copyrights of the photos & videos made by us for the wedding or any event. We can use them on our social media pages, websites, etc. Also you agree to allow us to tag you (your Facebook account) on our Facebook page. In case you don't want us to use any photo or video to use anywhere online, you need to buy complete copyrights of the work by making a payment of 50% extra of the ‘total project cost’.
The Photographer/ Film maker grants the client permission to share the images on social networking websites, with family and friends, and on vendor websites as long as the images remain unaltered and textual credit is explicitly given to the Photographer.

10. Other Team
There should be no other team of photographers or Cinematographers working on same project along side us. In such case quality might affect due to lack of coordination.

11. Film Maker Substitution
The Film Maker may substitute another Cameraman in the event of Film Maker’s illness or circumstances beyond his control. In the event of such substitution,
The Photographer /Film Maker warrants that the Cameraman shall be a competent professional.
